Rental Terms and Conditions

RESERVATIONS

1. These Rental Terms and Conditions (hereinafter referred to as “Rules”) define rules for the provision of services, liability and stay on the premises of the Property and are integral part of the contract, which is concluded by making a reservation or paying an advance or paying a deposit or a prepayment or the entire payment for a stay at the Property, Rynek-Ratusz 10, 50-106 Wrocław, according to the booking rules and conditions.

2. The party to the transaction and the contractor of the service is Inter-es Ponikowscy sp. z o.o. o. with registered seat in Wroclaw at Bałtycka 1 Street, 51-109 and its tax identification number NIP 8952025299. The Property consists of two facilities that have the trade names: "ABBA" and "Aparthotel New Lux" (hereinafter referred to as "Property").

3. The Rules apply to all Guests staying on the premises of the Property.

4. The Rules are available for viewing on the premises of the Property, as well as on the Property’s website: ​www……………………………….

5. The prices listed on the Property's website are gross prices, expressed in Polish ZLOTY and include all applicable fees.

6. The booking agreement is considered to be concluded once the confirmation of the reservation is sent to the e-mail address provided by the Guest or an SMS is sent to the Guest's telephone number.

7. The Guest receives a key card that provides access to both the main door and the apartment. The loss of the key card is associated with an additional fee of PLN 100 for each lost card.

8. In the course of booking the apartment (s), the Guest may request to use a parking space for an additional fee. The Property does not  however guarantee parking spaces due to their limited number.

9. The Guest is responsible for the correct completion of data in the reservation form. The Property is not responsible for an incorrect completion of the data form or incorrect selection of the date of arrival or departure.

10. The Property has the right to perform a service of a similar standard within the period specified in the reservation, when the provision of the reserved service proves impossible

11. The Property reserves the right to request the Guest to pre-authorize his/her credit card and the right to take a cash deposit in the amount of 200 - 1000 PLN per apartment, at the moment of checking-in.

12. Selecting the "I have read and accept the Booking Regulations in the Property "ABBA “and "Aparthotel New Lux” in Wroclaw and the terms of the offer" means that the Guest has read the Booking Regulations and these Rules, understands their provisions, agrees to their conditions and accepts the terms of the selected offer.

 

COMPLAINTS AND CANCELLATIONS

12. If, during his stay at the Property, the Guest discovers a deficiency in services provided by the Property (i.e. incompatible with the terms of the reservation and the description of the service posted on the Property's website), he should immediately notify the Property, either via email at the contact address newluxcentral@gmail.com or via text message sent to (+48) 665 142 848.

13. The deadline for addressing a complaint shall be 14 (fourteen) days of its receipt by the Property. The Property reserves the right to request further explanations that it deems necessary, 7 days

14. Reservation can be canceled via the reservation system where it was made, or by submitting cancellation request at the Property or by e-mail. The cost of canceling a reservation is determined by the terms of the offer in which the booking is made.

 

PRIVACY POLICY

15. At the time of booking, the Guest agrees to put their personal data in the database of the Operator or the Property.

16. This data will be used only to enable the full booking process to be carried out in accordance with the provisions of the Act of 29.08.1997 on the protection of personal data. The Guest has the option of creating a user account in the reservation system of the Operator of the Booking or the Object, thanks to which he will be able to make reservations also at other facilities using the System of the Booking Operator or the Object, without providing his personal data again

17. According to the provisions the Act of 29.08.1997 on the protection of personal data (consolidated text, Journal of Laws 2016 item 922 of 28 June 2016, as amended), the Guest has the right to request supplementing, updating or rectifying personal data, temporary or permanent suspension of their processing or removal, if it is incomplete, outdated, false or has been collected in violation of the law or is no longer needed to achieve the purpose for which  it was collected.

 

STAY AND APARTMENT DAY

18. Apartments are rented for apartment days.

19. Check-in is from 3 PM on the day of arrival and lasts until 11 PM. The Guest is obliged to check-out no later than 11.00 AM on the day of departure. (An apartment day lasts from 3 PM to 11 AM.

20. The Guest may request for late checkout. The Property reserves the right not to accept the request to extend the Guest’s stay.

21. Making the booking and payment for it or consent to extend the stay granted by the Property and the Guest’s payment for it is the basis for staying at the Property.

22. At the time of check-in, the Guests are required to show a physical credit card, photo ID, and a confirmation of the booking. The Property reserves the right to put a hold on your card in the amount of 500 - 1000 PLN upon arrival. 

23. The Guest is required to pay for the stay no later than on the day of arrival upon check-in.

24. In case of no-shows (i.e. when the Guest fails to check in at the Property by 11 pm on the day of arrival), the Property may cancel the reservation. No refund is made in such a case. The Guest has no right to transfer / resign or sublet the apartment to third parties.

25. Only persons specified in the check-in form are allowed to stay at the Property. Persons not specified in the check-in form may stay at the apartment only from 08:00 am to 10:00 pm.

26. The Property may refuse to accept a Guest who during the previous stay violated the Rules, in particular by causing damage to the Property or property of any of the Guests, damage to the Guests or employees of the Property or other persons staying in the Property.

27. The Property does not accept animals. It is prohibited to keep or bring bicycles and similar sports equipment to the Property.

28. The Property provides services in accordance with the Rules and the information indicated on the Property's website.

29. The Guest should exercise due care with regard to the equipment and any other devices of the Property.

 

LIABILITY OF THE GUEST

30. Children under the age of 12 should be under the constant supervision of legal guardians when on the premises of the Property. Legal guardians take full financial responsibility for any damages caused by their children or resulting from their children’s actions.

31. The Guests takes full financial responsibility for any damages and destruction to the equipment or technical devices of the Property, caused by the Guests or any person(s) visiting them. The Property reserves the right to charge the Guest’s credit card for any damage after his departure.

32. Using the apartments for purposes other than residential ones, e.g. organizing celebrations or social events is not allowed. Violation of this prohibition will result in the Guest's account being charged with a contractual penalty of 600 PLN as well as the possibility of terminating the Lease Agreement with immediate effect. The Guest is obliged to open the door for the Property staff. Failure to open the door may result in power disconnection to the apartment, to which the Guest agrees.

33. A loud party or other violation of the night time applies to noise levels equal to or higher than 45 dB measured at the door of the apartment.

 

LIABILITY OF THE PROPERTY

34. The Property is liable for loss or damage of the belongings brought by the Guest, unless the damage resulted from the nature of the property brought in or as a result of force majeure or that it was solely due to the Guest or the person who, with the consent of the Guest, stayed in the Guest’s apartment. The items brought within the meaning of this provision are the items that can be found at the premises of the Property at the time of the Guest’s stay at the Property.

35. All apartments are equipped with safe boxes, where the Guest is obliged to store money, securities and valuables. The Property is not responsible for any money, valuable items or other above mentioned items left outside safe box available in the apartment and left unsecured. If the Guest has items which value exceeds PLN 2,000, he is obliged to deposit them in a bank safe or other secure place outside the area where the services are provided by the Property.

36. The Guest shall inform the reception about the damage immediately after it occurs.

 

RETURN OF THINGS LEFT BEHIND

37. Personal belongings left by the Guests in the apartment after check out may be sent back to the address indicated by the Guest at Guest’s cost, after arranging and paying the courier delivery costs by the Guest. The Property will send an information to the Guest about things left behind and will wait 7 days for the disposition to handle them, e.g. packaging and waiting for a courier or destruction. In the absence of such an instruction, the Property will store these items free of charge for 1 month, followed by their destruction.

38.The Property is not responsible for any food, medicines and pharmaceutical products brought and left after the check out, in particular for their proper storage. The above-mentioned items left by the Guest will be disposed of immediately, in accordance with applicable sanitary regulations and occupational health and safety rules.

 

NIGHT TIME

39. There is a night time quite period observed throughout the property from 10 PM to 6 AM. Notwithstanding, the Guest undertakes to behave in a manner that does not disturb other Guests staying at the Property at all times.

 

FINAL PROVISIONS

40. There is an absolute ban on smoking tobacco products and e-cigarettes throughout the entire Property, both in the apartments as well as the common areas (except for the designated spot on the outside terrace located on the 5th floor). Any violation of the ban shall be subject to an additional fee of 1000 PLN for removing tobacco odour from the apartment or the common areas of the Property, which the Guest agrees to pay.

41. In the event of a breach of any of the provisions of these Rules, the Property may refuse to provide services to a person who violates them. Such a person is obliged to immediately comply with the demands of the Property, settle the receivables, pay the equivalent for any damage and to leave the facility.

42. It is prohibited to store any dangerous goods in the Property – weapons and ammunition, inflammable materials, explosives etc.

43. Guests are not allowed to make any changes to the apartments and their equipment.

44. In case of suspicion of violation of these Rules or suspicion of committing a crime or offense, the Property staff has the right to access the apartment at any time.

45. The Guest agrees to the storage and processing of his/her personal data in accordance with the Personal Data Protection Act, by Inter-es Ponikowscy sp. z o.o. o. with registered seat in Wroclaw at Bałtycka 1 Street, 51-109 and its tax identification number NIP 8952025299, for operations connected with the Guest's stay at the Property and the Guest’s use of any other services provided by the Property. The Guest has the right to inspect his personal data and correct it.

46. Polish law shall govern interpretation of the Rules.

47. The Rules shall enter into force on July, 1 2019.

Regulamin korzystania z Voucherów

I. Zasady Korzystania z Voucherów pobytowych

  1. Voucher ważny jest do końca roku, na który zrobiona została pierwotna rezerwacja.
  2. Voucher należy wykorzystać jednokrotnie i w całości. Niewykorzystanie w całości zakresu usług z Vouchera nie mogą być wykorzystane podczas kolejnej rezerwacji.
  3. Rezerwacja na wykorzystania voucher musi zostać założona za pośrednictwem tego samego OTA co pierwotna rezerwacja.
  4. Rezerwacja założona na podstawie vouchera musi zostać założona na minimum 7 dni przed planowanym rozpoczęciem pobytu.
  5. Voucher nie podlega zwrotowi i wymianie na gotówkę bądź inne formy płatności.
  6. Hotel nie ponosi odpowiedzialności za Voucher, który został utracony lub uszkodzony, po jego przekazaniu Nabywcy.
  7. Nabywcy lub Użytkownikowi Vouchera nie przysługują żadne roszczenia w stosunku do Hotelu z tytułu utraty (w tym również kradzieży) lub zniszczenia Vouchera jak i braku skorzystania z Voucheru w terminie jego ważności.
  8. Po dokonaniu rezerwacji na podstawie numeru przypisanego do Vouchera, Nabywca nie ma możliwości bezkosztowej zmiany terminu pobytu bądź dokonania zmian w rezerwacji.
  9. Termin ważności Vouchera widnieje na dokumencie.
  10. Data ważności Vouchera nie podlega przedłużeniu.
  11. Vouchery przewidują ograniczenia w zakresie dostępności terminów, w szczególności ograniczenia, co do pobytu w obiekcie w terminach: tzw. „Długich weekendów”, okresów: Świąt Bożego Narodzenia, Świąt Wielkanocnych, Sylwestra, Nowego Roku, wakacji, ferii.
  12. Wraz z otrzymaniem Vouchera Nabywca oświadcza, że zapoznał się z treścią Regulaminu, akceptuje w całości postanowienia Regulaminu oraz zobowiązuje się do jego przestrzegania
  13. W przypadku pytań odnośnie Voucherów prosimy o kontakt podany na dokumencie.
  14. Podstawą do wykonania usługi przez obiekt jest uprzednie (tj. przed rozpoczęciem realizacji danej usług/pobytu/rezerwacji) okazanie Vouchera.
  15. Wystawca nie gwarantuje dostępności usług. Brak miejsc, a przez to brak możliwości rezerwacji usług w obiekcie w terminie wskazanym przez Nabywcę nie rodzi po Stronie Wystawcy ani obiektu żadnej odpowiedzialności ani nie wpływa na wydłużenie terminu ważności Vouchera.
  16. W przypadku niewykorzystania Vouchera w zarezerwowanym terminie oraz nie odwołania rezerwacji do tygodnia przed przyjazdem, niewykorzystana kwota przepada a Voucher ulega anulacji.
  17. Nabywcy nie przysługuje prawo do otrzymania zwrotu reszty, w przypadku niewykorzystania całej kwoty, na jaką wystawiony został Voucher. W przypadku, gdy cena za usługę przewyższa wartość Vouchera Nabywca lub posiadacz Vouchera jest zobowiązany do zapłaty nieuregulowanej różnicy.
  18. Obiekt ma prawo odmówić realizacji Vouchera w następujących przypadkach: – upływ terminu ważności Vouchera, – uszkodzenie Vouchera uniemożliwiające odczytanie indywidualnego numeru identyfikacyjnego, – nie dokonano uprzednio rezerwacji.

II. Przetwarzanie danych osobowych

  1. Administratorem danych osobowych jest Inter-es Ponikowscy sp. z o.o. z siedzibą przy ul. Bałtyckiej 1, Wrocław 51-109.
  1. Podanie danych jest dobrowolne i jest warunkiem sprzedaży Vouchera i jego realizacji, a ich niepodanie uniemożliwi dokonanie sprzedaży i realizacji Vouchera. Dane przetwarzane będą w celu realizacji Vouchera, ustalania i dochodzenia ewentualnych roszczeń oraz wykonania ciążących na Wystawcy obowiązków prawnych wynikających z przepisów podatkowych lub przepisów o rachunkowości.
  2. Dane będą przechowywane przez okres niezbędny dla wykonania umowy i rozliczeń po jej zakończeniu oraz związanych z nimi obowiązków prawnych Administratora (w celach księgowych) oraz przez okres niezbędny do ustalenia, obrony lub dochodzenia ewentualnych roszczeń;
  3. Przysługuje Pani/Panu prawo do żądania dostępu do swoich danych osobowych, ich sprostowania, usunięcia, ograniczenia przetwarzania oraz ich przenoszenia. Przysługuje Pani/Panu prawo do wniesienia skargi do organu nadzorczego oraz cofnięcia zgody w dowolnym momencie bez wpływu na zgodność z prawem przetwarzania, którego dokonano na podstawie Pani/Pana zgody przed jej cofnięciem.
  4. Przysługuje Pani/Panu prawo do wniesienia sprzeciwu wobec przetwarzania Pani/Pana danych osobowych na podstawie prawnie uzasadnionego interesu administratora, a także sprzeciwu wobec przetwarzania Pani/Pana danych, w zakresie którym uprzednio Pani/Pan wyraziła/-ił zgodę.
  5. Administrator jest uprawniony do przetwarzania wyłącznie danych osobowych Nabywcy Vouchera. Administrator nie jest uprawniony do przetwarzania danych osobowych osoby trzeciej (posiadacza Vouchera), na rzecz którego Nabywca dokonał nabycia Vouchera, z uwagi na brak zgody osoby trzeciej na przetwarzanie jej danych osobowych przez Administratora.
  6. Mając powyższe na uwadze, nabycie Vouchera przez Nabywcę na rzecz osoby trzeciej, następuje w formie „na okaziciela” lub „imię i nazwisko” osoby trzeciej.
  7. Administrator nie jest uprawniony do przesyłania/przekazywania Vouchera osobie trzeciej, na rzecz której Nabywca nabył Voucher.
  8. W celu realizacji przysługujących Pani/Panu praw, związanych z przetwarzaniem Pani/Pana danych osobowych Pani/Pan może kontaktować się z Inspektorem Ochrony Danych dostępnym pod dedykowanym adresem e-mail newluxcentral@gmail.com
